Will he get 50/50 placement?

My ex boyfriend and I decided to go our seperate ways but we have an 8 month old son together. We went to mediation a few months ago and set up a visitation schedule which we both signed. He recently moved 30 min away from me and says he wants to pursue getting 50/50 placement. How likely will he be awarded that if we had just set something up...he also has been late to half of his visitations and always brings the baby back smelling like smoke.
